Terms and Conditions of Sales and Servicing

DEFINITIONS

Company: Refers to Automatic Gates and Doors Pty Ltd.

Client: Refers to the person/entity that orders/purchases goods and/or services from the Company.

1. QUOTATIONS

1.1 All quotations are subject to the condition that site dimensions remain consistent with the information provided. If changes to the dimensions arise, additional costs may apply to accommodate required modifications.

1.2 Quotations remain valid for a period of 14 days from the date of issue. After this period, the Company reserves the right to alter the terms, including price revisions.

2. ACCESS AND SITE PREPARATION

2.1 The Client must ensure clear, unimpeded access to the site at the agreed-upon times or as reasonably required by the Company. Any delay, lack of preparation, or failure to provide complete and accurate site information will entitle the Company to impose additional costs.

2.2 The Company reserves the right to charge additional fees for:

  • Site access restrictions or delays
  • Incomplete or incorrect site information
  • Unanticipated site conditions

3. PAYMENT TERMS

3.1 Full payment is required upon completion of installation unless otherwise agreed upon in writing by the Company. Payment must be made on the day of completion, and any withholding of payment must be authorised in writing by the Company.

3.2 Until full payment is received, the installed goods remain the property of the Company, and the Client consents to the Company retaining ownership rights.

4. OWNERSHIP AND RISK

4.1 Title to the goods does not pass to the Client until the full payment is received. The Client grants the Company a security interest over the property on which the goods are installed until the full payment is made.

4.2 Risk of damage or loss passes to the Client upon delivery and/or installation of the goods.

5. SITE CONDITIONS AND RESPONSIBILITIES

5.1 The Client is responsible for ensuring that property boundaries are respected and that any installation complies with relevant regulations.

5.2 Outdoor installations are subject to weather conditions, and the Company cannot be held responsible for delays caused by climatic factors.

5.3 The Client is responsible for ensuring the safe provision of electrical connections required for the operation of the installed equipment.

6. LIABILITY

6.1 The Company will take all reasonable care during installation but is not liable for damage to existing infrastructure such as plumbing, wiring, or surfaces unless due to the Company’s negligence.

6.2 The Company shall not be responsible for removing old gates or structures unless explicitly included in the quotation.

7. WARRANTY

7.1 The Company offers a 12-month warranty on products it manufactures from the date of installation. Any products not manufactured by the Company will be covered by the manufacturer’s warranty.

7.2 The warranty does not cover damage or faults caused by external factors, such as natural disasters, vermin, or improper use of the product. The Client is responsible for ensuring that the products are used and maintained appropriately.

7.3 Warranty services will be carried out during business hours (Monday to Friday, 8:30 AM to 4:00 PM), excluding public holidays. Out-of-hours services may incur additional charges.

8. SITE SAFETY

8.1 It is strongly recommended that all installations include safety features such as photoelectric beams to prevent accidents or damage caused by premature closing of gates or doors.

8.2 The Company reserves the right to refuse the installation of automatic gate closing mechanisms if the proper safety features are not in place.

9. REPOSSESSION RIGHTS

9.1 In the event of non-payment, the Company reserves the right to enter the Client’s property to repossess any installed goods. The Client grants the Company an irrevocable licence to access the premises for this purpose.

9.2 The Company is not liable for any damage incurred during the repossession process unless caused by negligence.

10. ORDER VARIATIONS AND CANCELLATIONS

10.1 Any variations to orders must be provided in writing and may be subject to additional costs.

10.2 Cancellations of orders within the production process or for completed orders will not be accepted. Deferred orders may incur warehousing fees.

11. INSURANCE

11.1 The Company is not responsible for insuring the goods once they leave the Company’s premises or upon completion of installation. Insurance of the goods post-installation is the responsibility of the Client.

12. RETURN OF GOODS

12.1 Any claims regarding the quality or condition of the goods must be made within seven (7) days of delivery. Returns will only be accepted with prior authorisation from the Company.

13. PRODUCT SPECIFICATIONS

13.1 The Company reserves the right to modify product designs and specifications without notice. The Client acknowledges that colour variations may occur due to different manufacturing processes.

14. EXCLUSION OF LIABILITY

14.1 To the extent permissible by law, the Company disclaims any liability for loss or damage arising from unauthorised repairs, interference, wear and tear, or any external factors affecting the operation of the installed goods.

14.2 The Company is not liable for the installation of a residential operator in commercial or industrial settings unless explicitly agreed upon in writing.

15. DISCLAIMER

The Company is not liable for any consequential loss or damage, including loss of profits, resulting from delays, defects, or any other issues beyond the Company’s control. The Client acknowledges that they have relied on their own judgement in selecting the product for their needs.
